Complaints about LOWI

On 17 July 2015 the Court of Amsterdam (ECLI:NL:RBAMS:2015:4472) ruledthat the LOWI is not an administrative authority according to the spirit of the Dutch General Administrative Law Act (Awb). It follows, among other things, that the National Ombudsman (NO) does not have the authority (anymore) to accept complaints about LOWI (see NO report 2015/140).

The LOWI wishes to adhere as much as possible to the warrants of the Dutch General Administrative Law Act (Awb). The LOWI itself will therefore, analogous with title 9.1 of this law, deal with complaints about LOWI. It will publish its Ruling on a complaint in anonymised form on its website. Complaints cannot be made in respect of the contents of an opinion issued by the LOWI.
